Your access to and use of telechoice.com.au is subject to the following terms, conditions and disclaimers ("Terms of Use") which govern your use and/or purchase of products from our website.

TeleChoice is not in the business of providing professional advice, and gives no warranty, guarantee or other representation about the accuracy of the information or images contained in this service. TeleChoice is not liable for errors, omissions in, delays or interruptions to or cessation of the services, or the withdrawal from sale or unavailability of products for whatever reason or cause.

Pricing & Products

All prices and products which are displayed and services which are offered for supply on telechoice.com.au are for internet orders only and are current at the time of issue but may change at any time without notice and are subject to availability. Unless otherwise stated, prices exclude GST.

All products offered for sale on this site, are offered subject to their availability at the time of order. A failure by a supplier to deliver in accordance with sample, description or at all or other unintentional causes may result in some lines being unavailable. Products are otherwise offered for sale while stocks last.

TeleChoice reserves the right to correct pricing, and other typographical and photographic errors and to limit the quantities of sales to customers, including the right to prohibit sales to re-sellers.

The offers made on this site are not available to re-sellers and there are no rainchecks available in respect of products advertised on this site, where stocks have run out.

Goods and Services Tax

If GST is imposed on any supply made by us through telstra.com, you must pay to us, in addition to any consideration payable or to be provided by you for this supply, an additional amount for the supply calculated by multiplying the prevailing GST rate by the consideration for the relevant supply payable or to be provided (without any deduction or set off) by you under any other clause in the Terms of Use. Any amount payable by you is payable on demand by us, whether such demand is made by an invoice or otherwise.

Orders & Delivery of Goods

Delivery Area − In order to purchase Goods from telechoice.com.au, the Delivery Address which You nominate will need to be within a location where telechoice.com.au provides delivery services. telechoice.com.au will advise You if the Delivery Address which You nominate ceases to be in an area where telechoice.com.au delivers goods. telechoice.com.au will not be obliged to continue to deliver Goods to You if You change Your Delivery Address and the new Delivery Address which You nominate is not in an area within which telechoice.com.au delivers goods.
Orders − You will place an Order with telechoice.com.au by selecting Goods on telechoice.com.au's website, entering your Personal Details and pressing the "submit" button. Orders will not be accepted until they are validated and processed during normal trading hours. Placing an Order does not constitute acceptance to supply. telechoice.com.au reserves the right to restrict Orders to retail quantities only.
Authorised Receipt of Goods − Anyone at the Delivery Address who receives the Goods shall be presumed by telechoice.com.au to be authorised to receive the Goods on Your behalf. telechoice.com.au may request that the person who receives the Goods at the Delivery Address provide satisfactory evidence of proof of age. telechoice.com.au will refuse to deliver the Goods if the person receiving the Goods is unable or unwilling to provide evidence of proof of age. The Goods will not be delivered to persons under the age of eighteen (18) years or to persons who fail to provide proof of age satisfactory to telechoice.com.au that the person is aged eighteen (18) years or over.
Price of Goods − The price paid for the Goods shall be the price specified on the Product List. You also agree to pay the delivery and handling fee (where applicable) in respect of each Order and all taxes, including goods and services tax, which telechoice.com.au is required to collect from you.
Method of payment − You shall pay for the Goods at the time of despatch. You may use Your credit card (Bankcard, MasterCard, Visa, American Express and Diners). Cheques may be accepted at telechoice.com.au's discretion. telechoice.com.au does not accept cash payment for the Goods.
Risk and Title − Risk in the Goods passes to You upon delivery of the products to the Delivery Address.
Returns or Refunds − If at any time You are not satisfied with the quality of the Goods You have purchased, You may call the telechoice.com.au customer service centre on (03) 98699 2555 and a customer service representative will assess your request for a credit or refund of the purchase price

Applicable Law

This site (excluding any linked third party sites) is controlled by TeleChoice. By accessing this site, you accept that any disputes about this site or its Content are to be determined by the courts having jurisdiction in the State of Victoria according to the laws in force in that State and subject to the application of any principle of conflict of laws inconsistent with this requirement.

As this site can be accessed throughout Australia and overseas, TeleChoice does not represent that the Content complies with the laws (including intellectual property laws) of any country outside Australia. If you access this site from outside Australia, you do so at your own risk and responsibility. You are responsible for making sure that you comply with all applicable laws in the place where you are located.

General Matters

If any of the Terms of Use are invalid or unenforceable, it will be struck out and the remaining terms will remain in force.

If we do not act in relation to a breach by you of the Terms of Use, this does not waive our right to act with respect to subsequent or similar breaches. You may not assign or transfer your rights or benefits under the Terms of Use to any other person or entity without our prior consent, which we will not unreasonably withhold.

From time to time telechoice.com.au may be changed (including these Terms of Use) or the information, products or services without notice. However, we do not undertake to keep this website updated.

Miscellaneous

If any provision of the Terms of Use is found to be invalid or unenforceable by a court of law, such invalidity or unenforceability will not affect the remainder of the Terms of Use which will continue in full force and effect. All rights not expressly granted are reserved. This agreement sets out the entire understanding and agreement between TeleChoice and you with respect to the subject matter.

Use of your information and material

When you send us any feedback, suggestions, ideas or other materials in relation to or via telechoice.com.au you agree that we can use, reproduce, publish, modify, adapt and transmit them to others free of charge and without restriction, subject to our obligations in our Privacy Statement.
